This End User License Agreement (“EULA”) incorporates the Apple Licensed Application End User License Agreement (Standard EULA) for apps distributed via the App Store, with the additions below. Where any conflict arises, Apple’s Standard EULA governs apps obtained from the App Store.
1. The Application
Hanzijo (the “Licensed Application”) is licensed, not sold, to you for use only under the terms of this EULA. The licensor (“we” or “Hanzijo”) reserves all rights not expressly granted to you.
2. Scope of License
We grant you a non-transferable license to use the Licensed Application on any Apple-branded products that you own or control, as permitted by the Usage Rules in the App Store Terms of Service. The license does not allow you to use the Licensed Application on devices you do not own or control, and you may not distribute or make it available over a network where it could be used by multiple devices at the same time.
3. Consent to Use of Data
You agree that we may collect and use technical data and related information — including device information and learning progress — to provide and improve the Service, as described in our Privacy Policy.
4. Subscriptions & In-App Purchases
Optional premium subscriptions are billed through your App Store account and managed under our Terms of Service and the App Store Terms.
5. Termination
This license is effective until terminated by you or us. Your rights under this license will terminate automatically if you fail to comply with any of its terms.
6. No Warranty
The Licensed Application is provided “as is” and “as available” without warranty of any kind, to the maximum extent permitted by applicable law.
7. Limitation of Liability
To the extent not prohibited by law, in no event shall we be liable for personal injury or any incidental, special, indirect or consequential damages arising out of or related to your use of, or inability to use, the Licensed Application.
8. Third-Party Beneficiary
You acknowledge and agree that Apple, and Apple’s subsidiaries, are third-party beneficiaries of this EULA, and that upon your acceptance of the terms and conditions of this EULA, Apple will have the right (and will be deemed to have accepted the right) to enforce this EULA against you as a third-party beneficiary thereof.
